Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the VIVA Taco Festival website, purchase or possession of VIVA tickets, registration for VIVA activities, and attendance at VIVA Taco Festival or related events.

VIVA Taco Festival is operated by Project Taco LLC (“VIVA,” “we,” “us,” or “our”).

By using our website, purchasing or accepting a ticket, registering for an activity, or entering the event, you agree to these Terms.

If you do not agree to these Terms, do not purchase a ticket, register for an event activity, or enter the event.

1. TICKETS AND ADMISSION

A valid ticket, registration, credential, wristband, or other required admission authorization may be required for entry into certain areas or activities.

Tickets may be subject to additional ticket-type restrictions shown at the time of purchase.

VIVA reserves the right to:

Verify tickets and registrations
Scan tickets upon entry
Require identification when appropriate
Refuse invalid, duplicated, altered, transferred, fraudulent, or previously redeemed tickets
Replace a ticket with a wristband, credential, or other admission method
Establish re-entry rules
Establish separate admission requirements for individual activities or areas

Possession of a ticket does not guarantee entry if the ticket holder violates these Terms, event rules, applicable laws, or safety requirements.

2. ALL SALES ARE FINAL

Except where required by applicable law or expressly authorized by Project Taco LLC, all ticket sales are final.

Tickets may not be refunded or exchanged because of a change of plans, inability to attend, travel issues, scheduling conflicts, weather, or changes to individual event programming.

Additional information is available in our Refund Policy, which is incorporated into these Terms by reference.

3. RAIN, SNOW, HEAT, OR SHINE

VIVA Taco Festival is a rain, snow, heat, or shine event.

Weather conditions may change throughout the event. Attendees are responsible for preparing appropriately for expected conditions, including heat, sun, wind, rain, cold, or other environmental conditions.

Weather alone does not automatically entitle a ticket holder to a refund.

Project Taco LLC may delay, suspend, relocate, shorten, modify, or cancel all or part of the event when reasonably necessary for safety or because of circumstances beyond our control.

4. EVENT SCHEDULE AND PROGRAMMING

All event information is subject to change.

Project Taco LLC may add, remove, substitute, reschedule, relocate, delay, or modify:

Performers
Entertainment
Vendors
Food and beverage offerings
Attractions
Competitions
Activities
Exhibits
Event hours
Stage schedules
Event layouts
Entrances and exits
Parking procedures
Restricted areas
Other programming or operational details

Changes to an individual performer, attraction, vendor, competition, or activity do not constitute cancellation of the entire festival.

5. EVENT RULES AND SECURITY

All attendees must follow posted rules and reasonable directions provided by event management, security personnel, law enforcement, venue personnel, and authorized event representatives.

For the safety of everyone attending, bags, containers, personal belongings, and other items may be subject to inspection as permitted by law.

VIVA may prohibit items that present a safety, security, operational, or legal concern.

Current prohibited-item and entry policies may be posted on the event website or communicated before or during the festival.

6. ATTENDEE CONDUCT

VIVA Taco Festival is intended to provide a welcoming environment for attendees, families, participants, vendors, performers, and staff.

Conduct that may result in removal from the event includes:

Fighting or threatening behavior
Harassment
Disorderly conduct
Excessive intoxication
Possession of prohibited items
Vandalism
Theft
Unauthorized entry into restricted areas
Interfering with event operations
Failure to follow safety instructions
Conduct that presents a danger to yourself or others
Violation of applicable laws
Violation of event or venue rules

Project Taco LLC reserves the right to refuse admission or remove any person whose conduct violates these Terms or presents a safety, security, legal, or operational concern.

A person removed for violating event rules is not entitled to a ticket refund except where required by law.

7. CHILDREN AND MINORS

Parents and legal guardians are responsible for supervising minor children attending VIVA Taco Festival.

Certain activities may have age, height, weight, registration, waiver, or supervision requirements.

Participation by a minor in certain organized activities may require consent or a separate waiver completed by the minor’s parent or legal guardian.

VIVA reserves the right to establish age restrictions for particular areas or activities.

8. ALCOHOL

Alcohol may be available in designated areas of VIVA Taco Festival.

You must be of legal drinking age and may be required to present valid government-issued identification to purchase, possess, or consume alcoholic beverages.

VIVA and its authorized alcohol vendors reserve the right to refuse alcohol service to any individual when appropriate or required by law.

Attendees are responsible for consuming alcohol responsibly.

9. FOOD, BEVERAGES, VENDORS, AND THIRD PARTIES

Many food vendors, merchants, exhibitors, sponsors, entertainers, and other participants at VIVA Taco Festival operate as independent businesses or third parties.

Unless expressly stated otherwise, Project Taco LLC does not manufacture or prepare products sold by independent vendors and does not control all aspects of their independent operations.

Questions concerning ingredients, allergens, preparation methods, dietary restrictions, or individual products should be directed to the vendor before purchase or consumption.

Attendees with food allergies or dietary restrictions are responsible for making appropriate inquiries and decisions concerning food and beverage purchases.

10. PHOTOGRAPHY, FILMING, AND RECORDING

VIVA Taco Festival is a public event at which photography, video recording, live streaming, news coverage, and other forms of media production may occur.

By entering the event, you acknowledge that you may be photographed, filmed, or recorded.

To the fullest extent permitted by law, you grant Project Taco LLC and its authorized representatives the right to photograph, film, record, reproduce, publish, display, distribute, and otherwise use your image, likeness, and voice captured at the event for legitimate promotional, advertising, editorial, archival, social-media, and other event-related purposes without additional compensation.

This provision does not authorize uses prohibited by applicable law.

11. PERSONAL PHOTOGRAPHY

Personal photography and video may be permitted, subject to event rules.

Professional photography, commercial filming, media production, drone operation, live broadcasting, or use of professional production equipment may require prior written authorization from Project Taco LLC.

VIVA may restrict recording in specific areas or during specific activities.

12. ASSUMPTION OF RISK

Attendance at a large public event involves inherent and unavoidable risks.

These risks may include, without limitation:

Crowds
Uneven surfaces
Weather conditions
Heat exposure
Loud sounds
Moving vehicles or equipment
Food and beverage consumption
Physical activities
Attractions
Interactions with other attendees
Temporary event structures
Slips, trips, and falls
Other risks associated with attending a public festival

By voluntarily entering or participating in the event, you acknowledge and accept the ordinary and inherent risks associated with attendance and participation.

Nothing in these Terms is intended to waive rights or liabilities that cannot legally be waived under applicable law.

13. MEDICAL EMERGENCIES

If you experience or observe a medical emergency, contact event personnel or emergency services immediately.

By attending the event, you authorize emergency medical assistance to be requested or provided when reasonably believed necessary under the circumstances.

You remain responsible for your own medical expenses except where otherwise required by applicable law.

14. PERSONAL PROPERTY

Attendees are responsible for their own belongings.

To the fullest extent permitted by law, Project Taco LLC is not responsible for lost, stolen, misplaced, abandoned, or damaged personal property.

Any lost-and-found procedures announced for the event are provided as a convenience and do not create responsibility for lost items.

15. FORCE MAJEURE

If performance of an event-related obligation becomes impossible, hazardous, impracticable, or materially impaired because of circumstances beyond the reasonable control of Project Taco LLC, performance may be delayed, modified, suspended, or excused to the fullest extent permitted by law.

Such circumstances may include:

Acts of God
Extreme or dangerous weather
Natural disasters
Fire
Flood
Earthquake
Epidemics or public-health emergencies
War
Terrorism or threats of terrorism
Civil unrest
Riots
Strikes or labor difficulties
Venue accidents or interruptions
Utility or infrastructure failures
Government orders
Acts or orders of public authorities
Public-safety emergencies
Other circumstances beyond the reasonable control of Project Taco LLC

Any refund or ticket remedy following such an event will be governed by the Refund Policy and applicable law.

16. RELEASE AND LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Project Taco LLC and its owners, officers, employees, agents, representatives, affiliates, contractors, sponsors, event partners, volunteers, venue operators, and other authorized event representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from attendance at, participation in, or inability to attend the event.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Project Taco LLC and its owners, officers, employees, agents, representatives, affiliates, contractors, and event partners from claims, losses, liabilities, damages, or reasonable costs arising from your unlawful conduct, violation of these Terms, or intentional or negligent acts that cause injury or damage to another person or property.

This attendee provision is separate from any additional indemnification requirements that may apply to vendors, exhibitors, contractors, sponsors, car-show participants, competition participants, or other registered event participants.

18. VENDORS, EXHIBITORS, AND EVENT PARTICIPANTS

Vendors, exhibitors, sponsors, contractors, performers, car-show entrants, tournament participants, volunteers, and other organized participants may be required to accept additional agreements, waivers, rules, indemnification provisions, or participation requirements.

Those separate agreements supplement these Terms and may contain additional obligations specific to the activity.

19. THIRD-PARTY SERVICES

The VIVA website may link to or integrate services operated by third parties, including ticket providers, payment processors, social-media services, advertisers, vendors, and sponsors.

Use of those third-party services may be governed by separate terms and privacy policies.

Project Taco LLC is not responsible for the content, availability, security, or independent practices of third-party websites or services.

20. WEBSITE CONTENT AND INTELLECTUAL PROPERTY

Unless otherwise indicated, VIVA Taco Festival branding, logos, graphics, website content, photographs, videos, designs, text, and other original materials are owned by or licensed to Project Taco LLC.

You may not reproduce, sell, distribute, modify, exploit, or use VIVA intellectual property for commercial purposes without prior written permission.

Names, logos, and trademarks belonging to third-party sponsors, vendors, performers, and partners remain the property of their respective owners.

21. WEBSITE ACCURACY

We make reasonable efforts to keep event information current. Because live-event information changes frequently, we cannot promise that every website page, advertisement, social-media post, or promotional material will always reflect the most recent schedule or operational information.

When significant changes occur, VIVA may communicate updates through its website, email, social media, ticketing platform, on-site signage, or other reasonable methods.

22. PRIVACY

Use of the VIVA website is also subject to our Privacy Policy.

By using the website, you acknowledge that information may be collected, processed, and shared as described in that policy.

23. GOVERNING LAW

These Terms will be governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where federal law or another applicable law requires otherwise.

To the extent permitted by law, disputes concerning these Terms or VIVA Taco Festival will be handled in a court of competent jurisdiction located in Nevada.

24. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed from these Terms, and the remaining provisions will continue in effect.

25. NO WAIVER

Failure by Project Taco LLC to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or any other provision in the future.

26. CHANGES TO THESE TERMS

Project Taco LLC may update these Terms from time to time.

The current version will be posted on the VIVA Taco Festival website with its effective date.

Ticket purchases and event attendance may also be subject to event-specific terms presented at the time of purchase or registration.
